Acceptance of Terms
By accessing or using AnonX, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our platform. Because AnonX is an interactive computer service, your continued use, browsing, or uploading of content constitutes your binding acceptance of these Terms.
Eligibility and Age Restrictions
By using AnonX, you represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction). If you are under the age of 18, you are strictly prohibited from using the platform, submitting community requests, or uploading media. AnonX does not knowingly collect or solicit data from anyone under the age of 18.
User Conduct & Zero-Tolerance Policy
You agree to use AnonX in a manner that is lawful, ethical, and respectful of others. You are responsible for your actions and any content you post on our platform. Prohibited conduct includes, but is not limited to:
- Posting illegal, harmful, or offensive content.
- Harassing, bullying, or threatening other users.
- Impersonating others or creating fake accounts.
- Engaging in spamming or other disruptive behavior.
- Violating the rights of others, including intellectual property rights.
- Attempting to gain unauthorized access to other users' accounts or the platform.
- Using AnonX for any commercial purposes without our prior written consent.
- Engaging in any activity that could damage, disable, or impair the functioning of AnonX or interfere with other users' access to the platform.
- Engaging in any activity that circumvents technical limits, file size restrictions, or format limitations imposed by the platform.
- Utilizing AnonX as a remote storage or file-hosting service for non-interactive viewing.
Posting Child Sexual Abuse Material (CSAM) or any illegal content depicting harm to children is strictly prohibited. AnonX maintains an absolute zero-tolerance policy for such content. Any instances of CSAM will result in an immediate, permanent ban, destruction of data, and immediate reporting to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement authorities, along with all associated metadata (IP addresses, timestamps, etc.).
User-Generated Content and Section 230 Protections
AnonX operates as an interactive computer service provider under Section 230 of the Communications Decency Act (47 U.S.C. § 230). You expressly acknowledge and agree that:
- Accountability: You are entirely responsible for the content of, and any harm resulting from, any images, text, or other material you post to AnonX (collectively, "Content"). AnonX acts solely as a passive conduit for the online distribution and publication of user-submitted content.
- No Pre-Screening Obligation: AnonX does not pre-screen, pre-approve, or actively monitor all Content posted to the platform. While we reserve the right (but do not assume the obligation) to review, flag, filter, modify, refuse, or remove any Content that violates these Terms, you acknowledge that you may be exposed to Content that you find offensive, indecent, or objectionable.
- Liability Waiver: AnonX assumes no liability or responsibility for any Content posted by you or any third party.
4.1 Automated Screening and Content Moderation Disclaimer
AnonX utilizes automated systems, including Artificial Intelligence ("AI"), to screen user-submitted images, videos, and text for potentially harmful, illegal, or violating content. You explicitly acknowledge and agree that:
- No Guarantee of Accuracy: Automated screening is provided on a "best-efforts" basis. AnonX does not guarantee that the AI will detect all violating content, nor do we guarantee that the AI will not occasionally flag benign content in error.
- No Voluntary Liability: The use of automated screening tools does not constitute an assumption of liability by AnonX for user-generated content. AnonX remains protected under 47 U.S.C. § 230, and the ultimate legal responsibility for any posted content rests solely on the user who uploaded it.
- System Modification: AnonX reserves the right to adjust, upgrade, or change its AI moderation filters at any time without notice to you.
4.2 DMCA Copyright Policy & Takedowns
AnonX respects the intellectual property of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond expeditiously to claims of copyright infringement. If you believe your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information at legal@anonx.app:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with enough detail so that we may locate it (e.g., the URL).
- Your address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Content Ownership and License
You retain ownership of any content you post on AnonX. However, by posting content on our platform, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, transcode, encode, format, store, crop, preview, modify, adapt, publish, translate, and distribute your content in connection with operating, promoting, and improving our services.
AnonX Intellectual Property
The AnonX platform, including its original content (excluding User Content), features, source code, functionality, logos, and UI/UX, are owned by AnonX LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not scrape, copy, modify, distribute, or reverse engineer any part of our platform without our express written consent.
Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information when you use AnonX.
Community Creation and Management
Users may request the creation of dedicated topical areas ("Communities"). AnonX reserves the absolute right to approve, deny, disable, or dismantle any Community at our sole discretion, with or without cause, and without prior notice.
If you provide optional contact information with your community request, you agree that AnonX may retain this data securely to communicate with you regarding your community. If you are granted the ability to moderate a Community ("Moderator"), you agree that you are a voluntary helper and not an employee, agent, or representative of AnonX. You agree to enforce these Terms of Service fairly. AnonX reserves the right to revoke your Moderator status at any time and assumes no liability for the actions, omissions, or moderation decisions made by user-moderators.
Termination and Moderation Rights
We reserve the right to terminate or suspend your access to AnonX, or remove/disable any content, at our sole discretion, without notice, for conduct that we believe violates these Terms of Service, or is harmful to other users, third parties, or our platform.
Disclaimer and Limitation of Liability
AnonX is provided on an "AS IS" and "AS AVAILABLE" basis. We are not responsible for the content shared on our platform and do not endorse or condone any illegal or harmful activities.
Indemnification
You agree to defend, indemnify, and hold harmless AnonX, its developers, operators, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third-party right, including without limitation any copyright, trademark, property, or privacy right; or (iv) any claim that your Content caused damage to a third party.
Dispute Resolution and Class Action Waiver
Please read this section carefully. It affects your legal rights. You and AnonX agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively through final and binding arbitration on an individual basis, rather than in court. You and AnonX expressly waive the right to a trial by jury or to participate in a class action, collective action, or representative proceeding.
Governing Law, Jurisdiction, and Severability
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law principles. Except for disputes subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Atlantic County, New Jersey.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect.
